They are suing Capistrano Unified School District over the attendance boundaries, claiming the school board put racial balance ahead of safety and neighborhood cohesion.   NEW YORK -- A police officer who shot an unarmed immigrant to death in a warehouse was spared a prison sentence Friday and was instead given five years' probation and 500 hours of community service. Justice Robert Straus said he believed 27-year-old Brian Conroy was a decent man who had been poorly trained by the New York Police Department. Conroy contended that Ousmane Zongo, 43, a native of the western African country of Burkina Faso who repaired art and musical instruments, tried to disarm him. He said he shot Zongo in self-defense.   PROVIDENCE, R.I. -- A police department's training was not to blame for the death of an off-duty black officer, who was fatally shot by two white colleagues, a federal jury ruled. Sgt. Cornel Young Jr., 29, was in plain clothes in 2000 when he was killed outside a diner as ran to respond to a fight. The shooting sparked charges of racism on the police force and led the department to drop a requirement that officers carry their guns while off duty.

Behan, 61, is the only priest charged in Philadelphia since the church abuse scandal broke in 2002. Behan performed oral sex on the 15-year-old boy dozens of times from 1978 to 1980, when he taught at Northeast Catholic High School for Boys, prosecutors said. Behan pleaded guilty in February to involuntary deviate sexual intercourse and corruption of minors. He was sentenced to 12 years of probation. Prosecutors sought a prison sentence of 11 to 22 years.
