(Black) Teen charged in Raleigh Oakwood shooting (of White man) made video confession -
Jason BeyerShabar Marshall, Jahaad MarshallRALEIGH, N.C. -- One of two brothers accused of a home invasion in Raleigh's historic Oakwood neighborhood that left a man paralyzed made a video confession to police shortly after his arrest. News of the evidence came out Thursday at a pretrial hearing, but a judge ruled the video cannot be used against Shabar Marshall because he had not waived his right to have his father or an attorney present when he was present. Marshall was just 16 at the time of his arrest. Although that made him old enough to be charged as an adult in the crime, he was still considered a juvenile under the laws concerning the legal rights of suspects being questioned by police. Shabar Marshall and his 27-year-old older brother Jahaad are accused of entering the East Lane Street home of Jason Beyer in January. They surprised the homeowners in bed, and at one point Shabar said he sexually assaulted the woman. In the brutal home invasion, the brothers allegedly shot Beyer in the back when he tried to stop an attack on his wife. That shooting left Beyer paralyzed from the waist down. - (Black-on-white)

Smithers will be sentenced in February to 120 months in prison. In turn, a second count of manslaughter in second degree will be dropped.     Prosecutors seek to prevent release of (black) 'Bolder Than Most' rapist
Alvin Ray Quarles Cynthia Medina and Mary Taylor San Diego County prosecutors are attempting to keep one of the region’s most infamous rapists in custody even though he has served 25 years in prison and is set for parole. At a Superior Court hearing the judge set a Dec. 19 hearing on whether Alvin Ray Quarles should be released or determined to be a "sexually violent predator" and sent to a state hospital for sex offenders until he is judged to no longer be a threat to the public. "Protecting our community from sexually violent predators is a priority for the DA's office and we're working diligently to have this defendant committed to a state hospital for an indeterminate term," said district attorney spokesman Steve Walker. Dubbed by police the “Bolder Than Most Rapist,” Quarles, now 51, attacked his victims at knife point, sometimes forcing the women’s husbands or boyfriends to watch, and in some of his attacks, forcing the men to have sex with the women while he watched. - (Black-on-white)

Black maintenance man strangled 93-year-old White woman and slit her throat during attempted rape
Evelyn NorellElton WaltersThere was no mystery killer behind the brutal slaying of a 93-year-old Pembroke Pines condo resident, a Broward jury decided Thursday. No unknown assailant strangled Evelyn Norell and then slit her throat with a gash so deep it reached her spine. No mix-up at the crime lab put her DNA in the boxers of the maintenance man who was in her apartment the day she died, as the defense implied. The maintenance man, Elton Walters, was convicted of Norell's murder on Thursday. The jury took nine hours over two days to reject almost all defense arguments. Walters, 67, was also convicted of armed robbery and armed burglary in the Oct. 6, 2009 attack that left Norell dead in her condo at the Images community. He faces the death penalty. The only concession the jury made to the defense was on the charge of armed sexual battery. Because prosecutors never established that Walters penetrated the victim, the jury convicted him of the lesser charge of attempted sexual battery. - (Black-on-white)

Black who killed, raped White woman in 1991 is finally set to be executed
Darius KimbroughDenise Collins (left) and her mother, Diane Stewart, were closeORLANDO, Fla. -- Denise Collins was found nude, moaning, covered in blood and barely conscious in her apartment's bathroom in October 1991. The sliding glass door to the second-floor balcony was partially open, and there were ladder impressions in the ground underneath the balcony. The 28-year-old aspiring artist was rushed to a hospital where she died the next day. Detectives found semen on her sheets and pubic hairs in her bed and in a towel. A neighbor in Collins' Orlando complex told detectives he had seen a man near Collins' apartment near a ladder by the apartment's balcony, and the neighbor later identified Darius Kimbrough, 19, as the man from a picture lineup. A maintenance man at the complex also said Kimbrough had watched him putting away a ladder in the complex around the time of the murder. Kimbrough was charged with the first-degree murder, sexual assault and burglary almost a year later. He was found guilty at his 1994 trial, during which experts testified that blood and semen samples taken from Collins' bed were compatible with Kimbrough's DNA. More than two decades after Collins' death, Kimbrough is scheduled to be executed Tuesday.
"He lived 22 years too long and too well and he's going to go out clean and easy, and he doesn't deserve it," said Diane Stewart, Collins' mother, in a recent telephone interview. "She didn't go out that way, and he doesn't deserve what he's getting. He should go out the way she did. That's how we feel." - (Black-on-white)

Appellate court: Retry Stanley Liggins for 1990 (black-on-white) rape-murder of 9-year-old girl
Stanley Liggins Jennifer Ann LewisThe promise made to child murder victim Jennifer Ann Lewis still stands: No matter how many times Stanley Liggins appeals, Mary Maxwell-Rockwell will be there. Liggins, now 51, has twice been convicted in the 9-year-old Rock Island girl's murder. Jennifer's smoldering body was found in a garbage bag in the schoolyard at Jefferson Elementary, Davenport, in 1990. She had been sexually assaulted and strangled. After a Scott County jury found him guilty of the murder in 1993, the Iowa Supreme Court overturned the conviction on a technicality. He was again found guilty in a change-of-venue trial in Dubuque in 1995. On Wednesday, the Iowa Court of Appeals reversed the second conviction. "I guess, any time you hear there's a chance ... there's that little shadow of a doubt where you know this could happen," Mary Maxwell-Rockwell said of the reversal Wednesday. She is a family friend who sat through both trials on behalf of Jennifer's parents, Sheri and Joe Glen, who were not permitted in the courtroom. "If this goes to court five more times, I'll go five more times. "I made the promise to Jennifer the day she died that I would see this through.
