(Black) Teen charged in Raleigh Oakwood shooting (of White man) made video confession - RALEIGH, N.C. -- One of two brothers accused of a home invasion in Raleigh's historic Oakwood neighborhood that left a man paralyzed made a video confession to police shortly after his arrest. News of the evidence came out Thursday at a pretrial hearing, but a judge ruled the video cannot be used against Shabar Marshall because he had not waived his right to have his father or an attorney present when he was present. Marshall was just 16 at the time of his arrest. Although that made him old enough to be charged as an adult in the crime, he was still considered a juvenile under the laws concerning the legal rights of suspects being questioned by police. Shabar Marshall and his 27-year-old older brother Jahaad are accused of entering the East Lane Street home of Jason Beyer in January. They surprised the homeowners in bed, and at one point Shabar said he sexually assaulted the woman. Black maintenance man strangled 93-year-old White woman and slit her throat during attempted rape There was no mystery killer behind the brutal slaying of a 93-year-old Pembroke Pines condo resident, a Broward jury decided Thursday. No unknown assailant strangled Evelyn Norell and then slit her throat with a gash so deep it reached her spine. No mix-up at the crime lab put her DNA in the boxers of the maintenance man who was in her apartment the day she died, as the defense implied. The maintenance man, Elton Walters, was convicted of Norell's murder on Thursday. The jury took nine hours over two days to reject almost all defense arguments. Walters, 67, was also convicted of armed robbery and armed burglary in the Oct. 6, 2009 attack that left Norell dead in her condo at the Images community. He faces the death penalty. The only concession the jury made to the defense was on the charge of armed sexual battery. Because prosecutors never established that Walters penetrated the victim, the jury convicted him of the lesser charge of attempted sexual battery. - (Black-on-white) |

Black who killed, raped White woman in 1991 is finally set to be executed ORLANDO, Fla. -- Denise Collins was found nude, moaning, covered in blood and barely conscious in her apartment's bathroom in October 1991. The sliding glass door to the second-floor balcony was partially open, and there were ladder impressions in the ground underneath the balcony. The 28-year-old aspiring artist was rushed to a hospital where she died the next day. Detectives found semen on her sheets and pubic hairs in her bed and in a towel. A neighbor in Collins' Orlando complex told detectives he had seen a man near Collins' apartment near a ladder by the apartment's balcony, and the neighbor later identified Darius Kimbrough, 19, as the man from a picture lineup. A maintenance man at the complex also said Kimbrough had watched him putting away a ladder in the complex around the time of the murder. Kimbrough was charged with the first-degree murder, sexual assault and burglary almost a year later. He was found guilty at his 1994 trial, during which experts testified that blood and semen samples taken from Collins' bed were compatible with Kimbrough's DNA. More than two decades after Collins' death, Kimbrough is scheduled to be executed Tuesday. "He lived 22 years too long and too well and he's going to go out clean and easy, and he doesn't deserve it," said Diane Stewart, Collins' mother, in a recent telephone interview.
